In 1938, scientists knew of just seven insect and mite species that had acquired resistance to pesticides. By 1984 that figure had climbed to 447 and included most of the world’s major pests. In response to heavier pesticide use and a wider variety of pesticides, pests have evolved sophisticated mechanisms for resisting the action of chemicals designed to kill them. Pesticides also kill the pests’ natural enemies, much like antibiotics kill the natural enemies of harmful bacteria in the body.” Have you ever watched a news broadcast and heard about someone who got lost in the woods and survived because they ate wild plants they knew were safe? OK, this isn’t a scenario most of us would ever find ourselves in, but who knows? Accidents happen. What would happen if there was a real disaster, such as an earthquake, nuclear bomb, or some other type of civil unrest that left you unable to visit a grocery store for weeks or maybe even months? It never hurts to know exactly how to find edible foods in the wild should the need arise. Did you know that even just knowing 4 edible plants can mean the difference between life and death? The time to learn is now. Don’t wait until an emergency situation comes up; you should be able to walk out to areas close to your home and be able to identify plants or parts of trees that are edible. It takes a bit of practice. One of the main things you want to consider is how to establish between an edible plant and a poisonous one. Although you don’t have to have an extensive knowledge, there are a few simple rules you can commit to memory and you should be fine. Avoid Plants That Have: An almond scent to the leaves or woody parts Plants with a three leaf growth pattern Milk or any type of colored sap Spines, thorns, or fine “hairs” Bulbs, beans, or seeds that are inside a pod Soapy or bitter taste Dill, parsley, carrot, or parsnip type of foliage Grains that have black, purple, or pink spurs Of course these rules don’t apply to plants or seeds that you know are safe, but if you aren’t sure, this is a good list to go by. Many poisonous plants show one or more of the above characteristics. Better to avoid an edible plant than to eat a poisonous one. Commit that list to memory, then print out some pictures of the following edible plants so that you can become accustomed to what they look like and easily identify them should the need arise. PLANTS, SEEDS, AND EDIBLE WILD GRAINS 1. AMARANTH (AMARANTHUS RETROFLEXUS) This plant is native to the Americas but is now found on almost every continent. Amaranth is an edible weed that the Aztecs used for food on a regular basis. You can eat all parts of this plant; however, some species have spines on the leaves. Although they are not poisonous, the spiny leaves of this plant contain oxalic acid, so it’s a good idea to boil the leaves if you can. If you have this plant growing locally without spines, feel free to dig it up and eat all parts of it. The seeds of this plant are especially delicious.  Photo credit: bigstock.com 2. WILD ASPARAGUS Yep, the veggie that makes your pee smell funny grows wild in most parts of North America, Africa, and Europe. Wild asparagus is thinner than the kind you are used to seeing at the grocery store, but it will be easily recognizable. This is a great way to get some vitamin C, vitamin B6, thiamine, and potassium. You can boil it or just eat it raw right out of the ground.  Photo credit: bigstock.com 3. BURDOCK (ARCTIUM LAPPA) This plant is native to Eastern Hemisphere but it has been naturalized in most of the Western Hemisphere as well. This is a super popular food in Japan. The leaves are bitter, however, so you might want to boil them twice to remove that taste. You can eat everything on this plant including the leaves, the peeled stalk, and the root. Burdock is a medium to large sized plant with big leaves and purple thistle like flowers. In America, many people use burdock root to make tea for detox purposes, so if you learn to identify it, you can harvest it wild and have fresh tea on a regular basis.  Photo credit: bigstock.com 4. CHICKWEED (STELLARIA MEDIA) This herb grows just about everywhere. It has very large leaves and small white flowers May through July. Eat the leaves raw, or you can cook them.  Photo credit: bigstock.com 5. DANDELION (TARAXACUM OFFICINALE) Yep, that annoying little plant that is a blight on your perfect lawn. You will think differently about this plant should you need to find something to eat someday. This entire plant is edible: flowers, leaves, and roots. Eating smaller, younger leaves is preferable as larger leaves tend to be bitter. If you need to, however, you can always boil the leaves to remove that bitter taste. Read more how to harvest dandelion. You might want to boil the roots as well so they are soft. Drink the water that you boiled the roots in as a stimulating and healthy tea and use the flowers as a pretty salad additive.  Photo credit: bigstock.com 6. PLANTAIN (PLANTAGO) This is another “weed” that literally grows everywhere. This is a plant, not the plantain banana tree. Plantain has been used for thousands of years by humans as both food and medicine. Even if you live in the city, chances are good that plantain is growing in an abandoned lot near you! Plantain likes wet areas best, but it will grow almost anywhere. Leaves are about 6 inches in length and 4 inches wide. They are oval, ribbed with short stems that, despite their size, tend to hug the ground.  Like many plants, plantain leaves are best eaten when young as they tend to get a bitter taste when more mature. However, if you are really in need of food, you can boil the leaves to remove that bitter taste. This plant is very high in calcium and vitamin A and even has a bit of vitamin C. Since this plant grows just about everywhere, it’s good that you learn to recognize it as sometimes, it might be one of the few edible plants you can find.  Photo credit: bigstock.com 7. GRASS OK, don’t shake your head and say “I am not a cow.” Humans have been eating grass and the seeds from grasses for as long as anyone can remember. There are literally hundreds of varieties of grass found around the world and perhaps 99 percent of them can be safely eaten. Grasses include oats, wheat, bamboo and wild grasses. Young grass shoots as tall as 6 inches can be eaten raw and the white base that usually comes out of the ground when you pull on it can be eaten, too. If you were lost in the wilderness, you could literally just pull handfuls of grass as you walk, eating it like trail mix. If the grass is much taller than 6 inches, it gets tough and woody, but if you were desperate, you could chew it then spit out the woody parts. You can also make tea from fresh or dried grasses. When it comes to grasses, the best things to look for and eat are the seed heads. If you find enough of them, you can use them in soups, stews, or grind them to make millet for bread. Never eat black or purple colored grass seeds as these probably have a toxic fungus. Eat tan, brown, or green seeds.  Photo credit: bigstock.com 8. ACORNS Acorns from oak trees are a terrific source of food in fall and early winter. Acorns are similar to nuts and they have a good amount of protein and fat, which can be super beneficial in keeping you alive or adding important calories to your diet if food becomes scarce. White Oak acorns can be eaten right out of the shell, but most other types of acorns are very bitter and will need to boiled two or three times, changing the water each time, before they have been leeched of those bitter tannins. After boiling you can strain the mashed acorns through a t-shirt, and can be eaten as is, or dried to be used as flour later on. You can even mix the acorns with some berries for a natural kind of cereal.  Photo credit: bigstock.com 9. CATTAILS Cattails can provide you with something to eat year round. In early spring, the young shoots and stalks can be eaten raw or cooked. Cattails have flowers in late spring, and these can be husked like you would an ear of corn and boiled. In fact, many people say cattail flowers taste something like corn! The flower heads will turn a brownish orange color in the summer. These, too, can be eaten raw or dried and pounded into flour. Fall, however, is perhaps the best time to gather the horn shaped corms, which you can eat raw or roast them. These are really tasty. In the winter, the root stalk is loaded with starches. This can be broken up in water, dissolved, then strained and dried, then made into flour similar to wheat.  Photo credit: bigstock.com 10. PRICKLY PEAR CACTUS (OPUNTIA) If you should end up stranded in the desert, the prickly pear cactus is a very nutritional plant that is super tasty. Knowing how to eat this plant can literally save your life if you are stuck in the desert. Prickly pear cactus has a “fruit” that looks like a purplish or red pear. You will need to carefully remove the small spines or spikes on the outer skin. Once you have removed all the stickers, you can eat this juicy “pear” seeds and all. Full of moisture, it can be a lifesaver. If need be, you can also eat the young stems of the cactus itself, but you should boil them before eating. You should also look for streams or rivers with fish, and know how to clean them. It’s not that difficult but knowing how to catch a fish and finding a few edible plants can make all the difference. Even if you can only find two or three edible plants near you, that is more than most people. With this information, you can not only survive, but you can actually thrive!(source)  11. ALOE VERA You probably have aloe vera at home in your medicine cabinet. The inside goo of this plant has excellent antibacterial properties. That means it can help keep a wound from getting infected, which means you might get to keep that toe after all.  12. BEE BALM Another antibacterial plant is bee balm. The red or purple flowers can also be brewed into an “Oswego tea” to relieve a fever. The leaves smell similar to bergamot oil (like you’d find in Earl Grey tea).  13.BONESET Use the leaves of boneset for tea to cure the most severe cases of fever (even dengue fever). Be cautious with this herb, though, because overdoses can be fatal.  14. YARROW While a tourniquet is often your best option for major bleeding, a yarrow poultice can also help stop bleeding. Chew a few leaves and apply to your wound. Now get yourself to a hospital. FOOD SOURCES Maladies are not your only worry when you’re far away from civilization. The following list presents all the sorts of things you created within the simulated reality that are not true, and do not exist: All hierarchy beings and systems, dimensions, heavens, rules, regulations, laws, justice, lies, deception, distrust, inability to have discernment, the sleight of hand scenarios, etc. and all that you know that you believe to be true in your reality does not exist!!! Are you done with your simulated virtual reality where you created the hunt and find routine, or to be hunted by others, to have perpetual lack of what you need and want, consistently limiting yourself and others, segmenting yourselves into have and have nots, ascending to a higher dimension of where you never created an exit plan? You are the creators of “Groundhog Day” – living in a time loop over and over and over again. Experiencing the same themes of pain and suffering over and over again but expecting a different outcome! This also created all the stories you know of today in your reality such as Alice in Wonderland, where she goes down the rabbit hole with no way out. Movies such as The Matrix, The Ghost in the Shell, The Circle, and Groundhog Day, all reveal the house of mirrors, mazes, and wheels within wheels of perpetual motion you all created, causing you to go deeper and deeper into your rabbit hole of your virtual reality which you all created. These things also created polarity, duality, dark matter with substance, and separation of self. You also fractured yourselves and others through all of the geometric shapes which creates more separation within yourself!! This in turn created multi-layering within and without an all-encompassing quantum entanglement of yourself with others and everything that ever exists in your reality! All of you have created quite a quagmire of complexities which many coin as a huge clusterf***. The bottom line is do you know how to get out this virtual reality game???? At this point there are 350,000 quadtrillion sectors times 1,000. And dimensions within dimensions that do not exist – space within space with openings into another space – it is much like the Russian Doll Effect! I am here today to give you notice that your game is done! I have found all of you and all final plans are being made to bring you all home. You all will take full responsibility for all that you have created, all that you have harmed, and you will have full comprehension and understanding of all the choices you made that you created to the fullest extent. This will be done before moving on to anything else. Your choices triggered an event that only took a millisecond to transpire, was contained by me in a millisecond, and “existed” in my space for approximately 30 yrs – and remember I AM where time does not exist. (twitter version here, and here) What mess? Judicial Watch: “…public records obtained…show 11 California counties have more registered voters than voting-age citizens.” What?? There’s more. “Los Angeles County officials ‘informed us that the total number of registered voters [in the County] now stands at a number that is a whopping 144% of the total number of resident citizens of voting age.’” FAR MORE REGISTERED VOTERS THAN THE TOTAL NUMBER OF PEOPLE WHO ARE OF VOTING AGE. That’s doesn’t work. That’s fraud. Now add this to the mix. Over a million illegal immigrants (some say far more) have received driver’s licenses in California. All of them (unless they specifically opt out), are automatically registered to vote by the Dept. of Motor Vehicles. Put all this insanity together, and what do you get? A gigantic number of people who can illegally cast votes. Because, in California, it’s legal to be illegal. Want to proceed further down the rabbit hole? It’s probable that many illegal immigrants don’t vote. If someone wanted to vote FOR them, how would that work? Not one at a time, unless some sinister organization had at least half a million foot soldiers on call, on Election Day. But here is a possible clue: electronic voting systems. Back in 2007, the secretary of state of California ordered a “Top-to-Bottom Review” of all electronic voting systems currently in use in California elections. In other words, up to that time, these systems had been considered a very fine way to run the vote count. The systems obviously had been tested and re-tested and checked and approved. They were already being used in the state of California. However, astoundingly, all the following electronic systems were found to contain fatal flaws: Premier Election Solutions (formerly Diebold); Hart InterCivic; Sequoia Voting Systems; Election Systems and Software. The first three systems were disqualified from further use…and then conditionally re-approved. The fourth system was rejected altogether. To suppose that, after this top-to-bottom review in 2007, everything was quickly fixed is a leap only the foolish and unwary would take—particularly when we are talking about extremely talented hackers who could be employed to change election-vote numbers. I read the California Top-to-Bottom Review. The public comments section at the end was illuminating. It contained explosive remarks. For example, there was a discussion of vendors pretending to sell certain voting machines to the state of California…but actually selling other machines…machines that were not certified for use. Another comment indicated that California lacked a method to ensure the source code for voting-machine software actually belonged to software certified by the state. All in all, there is no guarantee (far from it) that the California voting system is safe or effective or honest. If someone manipulated the system, and somehow utilized the huge numbers of illegal immigrants who are registered to vote, as a cover for falsified numbers… Who would use illegal immigrants in that way? You can answer that question. Now research is showing that chemotherapy could actually be exacerbating the presence and growth of cancer cells, especially in persons with breast cancer. A common treatment protocol for breast cancer patients is chemotherapy followed by surgical removal of the tumor. It is believed that the chemotherapy drugs both help to reduce tumor size as well as prevent cancer cells from spreading in the body. However, now it appears that the exact opposite might be occurring. Chemotherapy found to increase circulation of cancer cells It is believed this is happening due to a repair mechanism being switched on by the toxic medication, which ultimately allows cancer tumors to grow back stronger. The chemotherapy seems to create more pathways of blood vessels, and this in turn allows cancer to spread more readily to other parts of the body. Albert Einstein College of Medicine of Yeshiva University researchers in New York found the amount of these blood vessel doorways was higher in 20 patients who had been receiving two of the most commonly used chemotherapy drugs. It was also discovered that chemotherapy given to mice with breast cancer triggered the circulation of more cancer cells throughout the lungs and the rest of the body. Dr. George Karagiannis of the Yeshiva University Albert Einstein College of Medicine suggested that breast cancer patients could perhaps be monitored during chemotherapy for this type of circulation and the risk of new doorways being created. Success rate of chemotherapy negligible for most cancers, including breast cancer A small amount of tumor tissue could be tested after initial chemotherapy doses. If elevated levels were detected, the chemo could be stopped and surgery administered, followed by chemotherapy afterward instead. The study was published in the journal Science Translational Medicine. The researchers plan to study if the same effect occurs with other types of cancer. The late Nicholas Gonzalez, MD, a researcher, physician and true healer, was driven to alert people to the fact that breast cancer and organ cancers aren’t even helped by chemotherapy! Led by Dr. George Karagiannis, the research focused on chemotherapy treatment of breast cancer, but further studies plan to see how chemotherapy might also spread cancers of other tissues, too. The research was published in Science Translational Medicine and is entitled Neoadjuvant chemotherapy induces breast cancer metastasis through a TMEM-mediated mechanism. A summary of the study reports that “the authors discovered that several types of chemotherapy can increase the amounts of TMEM complexes and circulating tumor cells in the bloodstream.” It concludes that “chemotherapy, despite decreasing tumor size, increases the risk of metastatic dissemination.”  Chemotherapy spreads cancer, generating repeat business for the for-profit cancer industry In other words, even though chemotherapy “shrinks tumors,” it’s also spreading cancer throughout the body, functioning as a kind of activation for future cancer (that just so happens to generate repeat business for the cancer industry, of course). A web platform called “Elysium” was utilized by the pedophile network, which existed since the end of 2016 and was accessible only through the Darknet, a hidden part of the Internet uncatalogued by search engines. The site was used to facilitate the exchange of videos and images of children, as young as toddler age, being physically and sexually abused. According to German international broadcaster Deutsche Welle: “Investigators said the site had been in operation since the end of 2016 and that it was accessible only via the darknet, a part of the World Wide Web that cannot be found using conventional search engines but requires the use of encrypting software.” According to the authorities in Frankfurt, there were also recordings of “the most serious sexual abuse of children”, such as violence against children and abuse of “the youngest.”. The platform was also used to schedule appointments to exploit and abuse children. Most of the suspects were arrested in the countries of Germany and Austria. A German police spokesman said that Dutch authorities were also involved in the case: “We are certainly expecting things that are important to the Netherlands, but at the moment it is not yet possible to indicate to what extent.” Surprisingly, the network of nearly 90,000 individuals is not the largest bust in history, as another online Darknet pedophile platform called Playpen was dismantled earlier this year, and 58-year-old American Steven Chase sentenced to 30-years in federal prison. Chase was held responsible for the existence of Playpen, a child pornography network established in 2014, which had 150,000 active pedophiles on the site. The Playpen case was extremely controversial, as the U.S. Department of Justice acknowledged in court filings that the FBI actually operated the site, themselves, from Feb. 20 to March 4, 2015. Moreover, in a move that left many in dismay, the Department of Justice filed a motion in Washington State federal court to dismiss an indictment against the child porn site. According to a report in Wired: It wasn’t for lack of evidence; it was because the FBI didn’t want to disclose details of a hacking tool to the defense as part of discovery. Evidence in United States v. Jay Michaud hinged at least in part on information federal investigators had gathered by exploiting a vulnerability in the Tor anonymity network. “Because the government remains unwilling to disclose certain discovery related to the FBI’s deployment of a ‘Network Investigative Technique’ (‘NIT’) as part of its investigation into the Playpen child pornography site, the government has no choice but to seek dismissal of the indictment,” federal prosecutor Annette Hayes wrote in the court filing on Friday. The federal prosecutor pointed out that the DoJ’s work to resist disclosing the NIT was part of “an effort to balance the many competing interests that are at play when sensitive law enforcement technology becomes the subject of a request for criminal discovery.” To make a long story short, the feds decided to let an alleged child pornographer go to keep secret, and illegal, the methods they use to catch criminals on the dark web. In regard to the “Elysium” network, public prosecutor’s office in Frankfurt said that the suspected operator of the site, a 39-year-old man from the central German state of Hesse, had already been arrested on June 12. The suspected operator of the platform was arrested after his apartment was searched and the server seized, according to DW. Numerous other suspects have also been arrested, according to police officials. German and Austrian police said they will hold a press conference on Friday to provide further details about the investigation. In a 91-page decision, Judge James Boasberg ruled that the federal permits authorizing the pipeline to cross the Missouri River just upstream of the Standing Rock reservation, which were hastily issued by the Trump administration just days after the inauguration, violated the law in certain critical respects. The Court did not determine whether pipeline operations should be shut off and has requested additional briefing on the subject and a status conference next week. The federal judge wrote, “the Court agrees that [the Corps] did not adequately consider the impacts of an oil spill on fishing rights, hunting rights, or environmental justice, or the degree to which the pipeline’s effects are likely to be highly controversial.” “This is a major victory for the Tribe and we commend the courts for upholding the law and doing the right thing,” said Standing Rock Sioux Chairman Dave Archambault II. “The previous administration painstakingly considered the impacts of this pipeline, and President Trump hastily dismissed these careful environmental considerations in favor of political and personal interests. We applaud the courts for protecting our laws and regulations from undue political influence, and will ask the Court to shut down pipeline operations immediately.” “This decision marks an important turning point. The Standing Rock Sioux Tribe is deeply concerned about the construction of the major crude-oil pipeline that passes through its ancestral lands. What are the key legal issues in this case? The motion for summary judgment, filed on Feb. 14, asked the Judge to rule on major legal questions that have not yet been resolved during this case, including whether National Environmental Policy Act requirements have been met and whether the Corps’ actions violate the Tribe’s Treaty rights. Our lawsuit raises three critical claims, and asks the court to throw out the federal approvals. First, the law requires a full, transparent and public environmental review for any federal action that has “significant” environmental effects. These environmental reviews have been prepared for decisions as mundane as off-leash dog areas and allowing jet skis in parks. The idea that a 30-inch crude-oil pipeline under one of the most economically and culturally important waterways in the nation isn’t significant enough to warrant an environmental review is absurd. Second, the history of the U.S. government’s broken promises to the Sioux people is long and tragic. No one disputes that the Tribe has important Treaty rights that guarantee the integrity of its reservation. This means that the federal government and its agencies cannot take any federal action that harms the Standing Rock reservation or the water in the Missouri River on which the people of Standing Rock depend. The Obama administration made a carefully considered decision that these Treaty rights needed to be respected in connection with an oil pipeline immediately upstream of the reservation. The Trump administration ignored that advice, and acted as if the Tribe does not exist. And finally, there are limits on the extent to which one administration can reverse the decisions of its predecessor. While federal agencies can change their minds about matters of policy, the courts will set aside reversals that are not fully justified and explained. From The Standing Rock Sioux Tribe Setting The Record Straight. On Feb. 23, the Tribe issued a report on engagement on the Dakota Access Pipeline. The Tribe contacted the Army Corps, even before DAPL applied for permits, to express its deep concerns about the pipeline in this location and its effect on the Tribe’s treaty rights and cultural sites. (The full story.) In September 2014, the Tribe made its overwhelming objection to the proposal clear to DAPL representatives, and promised to fight them if they proceeded in the proposed location. A recording of what was said: (Transcript) The Corps did not hold 389 meetings with Tribes. A significant portion of that '389' number were requests from Tribes to the Corps seeking information about the proposed pipeline and the Corps’ process for reviewing it, raising concerns and objections, and requesting meetings to discuss those concerns—many of which were ignored by the Corps. The Tribe participated fully in the NEPA process. The Tribe submitted three lengthy sets of technical and legal comments on the December 2015 draft EA, comprising hundreds of pages, raising objections and seeking better analysis of spill risks and the Tribe’s treaty rights. The Tribe sought to protect its rights when no one else would. The Tribe refused to get out of DAPL’s way and allow them to do something the Tribe thought was illegal and immoral. Neither the Corps nor DAPL ever explained why, if the pipeline was so safe, they didn’t select the alternative route and cross the Missouri River north of Bismarck where the river is narrower. The Corps relied on flawed, one-sided analysis prepared by DAPL—and never subjected to any independent review—minimizing the risks of oil spill, and ignored the Tribe’s treaty rights to water, fishing, and hunting. In December 2016, the Corps correctly found that those issues needed further consideration through an EIS process. On his second full day in office, the Trump administration overruled the Corps and ordered the permits to be granted. Standing Rock Chairman Archambault was on his way to meet with the White House when the easement was issued—no one from the Trump administration ever talked to a representative of the Tribe before ordering the project to go forward. Timeline of Events: July 27, 2016 The Tribe files a lawsuit in federal district court in Washington, D.C., where it was assigned to U.S. District Judge James E. Boasberg. August 4, 2016 The Tribe asks the Court for a preliminary injunction since the pipeline is already under construction and would be finished before the case could be formally decided. August 24, 2016 Judge Boasberg holds a hearing on the motion in Washington, D.C. Over 500 people participated in an action outside the federal courthouse in support of the Tribe. The Judge indicated that he would rule in roughly two weeks. Sept. 3, 2016 While the parties are awaiting the Court’s decision, Dakota Access bulldozed an area of the pipeline corridor filled with Tribal sacred sites and burials that had been identified to the Court just the previous day. Demonstrators trying to prevent the destruction of the sacred site were pepper sprayed and attacked by guard dogs (as documented by Amy Goodman and her Democracy Now camera crew.) On Sept. 4, the Tribe files an emergency motion for a temporary restraining order to block the construction until a decision is reached on the injunction motion. Sept. 6, 2016 Judge Boasberg holds a hearing on the emergency motion for a temporary restraining order. The Judge issues a temporary restraining order for the pipeline corridor nearest the Missouri River but declines to halt construction on the portion of the pipeline route that had recently been identified as sacred tribal burial ground. Sept. 9, 2016 The Court denies the Tribe’s motion for a preliminary injunction. Minutes later, three federal agencies—The Department of Justice, Department of the Army and Department of the Interior—issue a joint statement announcing that the federal agencies will halt any additional permitting and reconsider its past permits of the project. The statement states that while it appreciates the Court’s review, the government believes that the Tribe has raised some important issues worthy of additional consideration. It also called for a national review of the government’s approach to Tribal consultation for major fossil fuel projects. Sept. 12, 2016 After filing an appeal of the District Court’s decision with the D.C. Circuit Court of Appeals, the Tribe files a request for an injunction pending appeal. The motion asks the Court to make the Government’s request for a voluntary pause on construction within 20 miles of Lake Oahe an enforceable requirement while the appeal process goes forward. Sept. 16, 2016 The Court issues an order issuing an “administrative injunction … to give the court sufficient opportunity to consider the emergency motion for injunction pending appeal.” The court directed “that Dakota Access LLC be enjoined pending further order of the court from construction of the Dakota Access Pipeline for 20 miles on both sides of the Missouri River at Lake Oahe.” Oct. 5, 2016 Oral arguments on the emergency motion for injunction are held at the Court of Appeals for the D.C. Circuit. A ruling was not issued, keeping the temporary halt to construction in place until the Court issues a decision. Oct. 9, 2016 The D.C. Circuit issues a ruling denying the tribe’s request for an injunction pending appeal but emphasizes that it hoped that the “spirit of Section 106 [of the National Historic Preservation Act] may yet prevail” as the Court did not have the last word, and decisions still need to be made at the permit crossing at Lake Oahe. Both the appeal and the district court litigation will proceed, but the injunction covering work in the pipeline corridor has ceased. Oct. 10, 2016 The Department of Justice, Department of the Army and Department of the Interior issue a joint statement following the court order which says in part: “The Army continues to review issues raised by the Standing Rock Sioux Tribe and other Tribal nations and their members and hopes to conclude its ongoing review soon. In the interim, the Army will not authorize constructing the Dakota Access Pipeline on Corps land bordering or under Lake Oahe. We repeat our request that the pipeline company voluntarily pause all construction activity within 20 miles east or west of Lake Oahe.” Dakota Access has forcefully rejected the Government’s request for a voluntary pause, and continues to pursue construction ever closer to the Missouri River and the camps of protesters. Oct. 20, 2016 The Army Corps conducts a site visit to the area bulldozed over Labor Day to determine whether Dakota Access violated federal law by knowingly damaging a tribal sacred site. Under federal law, if Dakota Access is found to have knowingly damaged a historic or cultural resource with the intent of sidestepping the National Historic Preservation Act, the Corps cannot issue the easement. No determination has been finalized. Oct. 24, 2016 As confrontations between Tribal water protectors and an increasingly militarized construction effort heat up, Tribal Chairman Dave Archambault II calls on the Department of Justice to conduct an investigation into heavy-handed police tactics and violations of civil rights. Nov. 2, 2016 Following comments from President Obama in an interview on Nov. 1, Tribal Chairman Dave Archambault II issues a statement, saying in part, “While the Army Corps of Engineers is examining this issue we call on the Administration and the Corps to issue an immediate ‘stop work order’ on the Dakota Access Pipeline.” Read the Tribe's full statement. “Earthjustice is honored to represent the Standing Rock Sioux Tribe in court as it seeks to protect its people’s sacred lands and water from the Dakota Access pipeline,” said Trip Van Noppen, president of Earthjustice, also in response to President Obama's Nov. 1 remarks. “We also want to reiterate the Chairman’s call for a full environmental impact statement. Nov. 3, 2016 An independent expert hired by the Standing Rock Sioux Tribe (Richard Kuprewicz of Accufacts, Inc., a consulting firm that advises government agencies and industry about pipelines) finds that the government’s environmental assessment of the Dakota Access pipeline’s environmental impact was inadequate. In light of Kuprewicz’s report and the deficiencies contained in the environmental assessment, Tribe Chairman Archambault II asked for the government to reconsider its early decisions and disallow the easement for the pipeline crossing. Nov. 10, 2016 The Department of Justice announces in federal court that it will be announcing the next steps on a 'path forward' for the Dakota Access Pipeline crossing at Lake Oahe. Nov. 14, 2016 The U.S. Army Corp of Engineers announces they are delaying an easement for the Dakota Access Pipeline project until it conducts further environmental review with the Standing Rock Sioux Tribe. “We are encouraged and know that the peaceful prayer and demonstration at Standing Rock have powerfully brought to light the unjust narrative suffered by tribal nations and Native Americans across the country,” says Standing Rock Sioux Tribal Chair David Archambault II. Nov. 15, 2016 Energy Transfer Partners, the company behind the Dakota Access Pipeline files a lawsuit charging the U.S. Army Corp of Engineers has no right to delay easement to pipeline construction. Nov. 21, 2016 The Standing Rock Sioux Tribe issues a statement calling on President Obama to deny easement, investigate pipeline safety and protect tribal sovereignty. Read the Tribe's statement. Nov. 25, 2016 Federal officials announce that a decision had been made to close access to the entire area north of the Cannonball River including the Standing Rock protest campsite at Oceti Sakowin. They said the decision was made because of public safety concerns and that a 'free speech zone' to the south of Cannonball River would be created. Nov. 28, 2016 The Water Protector Legal Collective, an initiative of the National Lawyers Guild, files a lawsuit in U.S. District Court against Morton County, Morton County Sheriff Kyle Kirschmeier, and other law enforcement agencies for using excessive force against peaceful protesters near the Standing Rock protest camp on the night of November 20. Standing Rock Sioux Tribe Chairman Dave Archambault II responds to Gov. Dalrymple's Nov. 28 executive order calling for mandatory evacuation of all campers located on U.S. Army Corps of Engineers lands (also known as the Oceti Sakowin camp), saying, in part, "If the true concern is for public safety than the Governor should clear the blockade and the county law enforcement should cease all use of flash grenades, high-pressure water cannons in freezing temperatures, dog kennels for temporary human jails, and any harmful weaponry against human beings." Dec. 9, 2016 Tribal representatives testify at a hearing by the Inter-American Commission on Human Rights. The hearing examined the impact of extractive industries and projects on the human rights of indigenous peoples, focusing on the Dakota Access Pipeline and the Standing Rock Sioux Tribe, the Cheyenne River Sioux Tribe, and the Yankton Sioux Tribe. Jan. 6, 2017 The Standing Rock Sioux Tribe files a motion with the U.S. District Court in Washington, D.C., asking District Judge James Boasberg to throw out Dakota Access’s lawsuit against the Army Corps of Engineers. The Department of Justice, which represents the Corps, files a similar motion. Jan. 18, 2017 The scoping notice soliciting public comment on the Environmental Impact Statement process for the Dakota Access Pipeline is published in the Federal Register. The notice opens the public scoping phase and invites interested parties to identify potential issues, concerns, and reasonable alternatives that should be considered in an EIS. Comments from the public are being requested through Feb. 20. Jan. 24, 2017 President Donald Trump takes executive action towards an approval of an easement for the Dakota Access Pipeline, risking contaminating tribal and American water supplies while disregarding treaty rights. “The existing pipeline route risks infringing on our treaty rights, contaminating our water and the water of 17 million Americans downstream,” said Dave Archambault II, chairman of the Standing Rock Sioux Tribe. “We are not opposed to energy independence. We are opposed to reckless and politically motivated development projects, like DAPL, that ignore our treaty rights and risk our water. Feb. 1, 2017 Senators Cantwell, Tester and Udall send a letter to the White House expressing their concern about the Presidential Memorandum issued January 24 and reports that the Army Corps of Engineers intends to grant a final easement allowing construction of the Dakota Access Pipeline without appropriate consultation with the Standing Rock Sioux Tribe and due process. Feb. 7, 2017 The Army Corps of Engineers notifies Congress that—within the next 24 hours—it will issue an easement to allow the Dakota Access Pipeline to cross under Lake Oahe in North Dakota near the Standing Rock Sioux Tribe reservation. Feb. 14, 2017 The Standing Rock Sioux Tribe files a motion for summary judgment, asking the Court to overturn recent Army Corps of Engineers permits of the pipeline issued without environmental review or consideration of treaty rights. The lawsuit challenges the Corps’ hasty and unexplained departure from its previous decision, and explains how the Corps ignored the Tribe’s treaty rights and seeks to destroy culturally significant and sacred sites. Feb. 15, 2017 North Dakota Gov. Burgum issues an emergency evacuation order of the Oceti Sakowin camp, ordering that the site be vacated by 2:00pm local time on Feb. 22. In a statement on Feb. 7, Standing Rock Chairman Archambault II had asked supporters to “please respect our people and do not come to Standing Rock and instead exercise your First Amendment rights and take this fight to your respective state capitols, to your members of Congress, and to Washington, D.C.” Feb. 23, 2017 The Standing Rock Sioux Tribe issues Setting The Record Straight, documenting engagement on the Dakota Access pipeline. Feb. 24, 2017 A buried memo from Interior Department's top lawyer surfaces in legal filings. The 35-page formal legal opinion, dated Dec. 4, found that the existing environmental assessment for the Dakota Access pipeline suffered from fatal flaws. The Trump administration quietly suspended the opinion as it prepared to approve the pipeline. Of the Trump administration's attempts to bury the memo, Earthjustice attorney Jan Hasselman said, "The Standing Rock Sioux deserve better. That's why we have courts." Read details. Apr. 5, 2017 The Standing Rock Sioux Tribe applauds BNP Paribas’ decision to divest from the Dakota Access Pipeline. “As corporate greed continues to fuel dirty energy projects on our land, it is heartening to see that some banks recognize the imminent harm to our people posed by DAPL, and are taking actions accordingly,” said Dave Archambault, Chairman of the Standing Rock Sioux Tribe. “We appreciate BNP Paribas, ING and DNB leadership and their advanced understanding and respect of tribal sovereignty and Indigenous Peoples’ rights.” May 10, 2017 The local South Dakota outlet Aberdeen News reports that a leak occurred in the not-yet completed Dakota Access pipeline on April 6. “Our lawsuit challenging this dangerous project is ongoing, and it’s more important than ever for the court to step in and halt additional accidents before they happen—not just for the Standing Rock Sioux Tribe and our resources, but for the 17 million people whose drinking water is at risk,” said Standing Rock Sioux Tribe Chairman Dave Archambault II. June 14, 2017 The Standing Rock Sioux Tribe wins a significant victory, when Judge James Boasberg rules that the federal permits authorizing the pipeline to cross the Missouri River just upstream of the Standing Rock reservation, which were hastily issued by the Trump administration just days after the inauguration, violated the law in certain critical respects. The Court did not determine whether pipeline operations should be shut off, requesting additional briefing on the subject and a status conference for the following week. Read the court opinion.
